ADULTERY
Adultery cases are generally handled by Private Investigators one of two ways depending
on weather you are going to court or if it is just for your own information. If you are going
to court and you want to file on the grounds of Adultery, or if it has been filed and you want
to prove Adultery then you need three things to satisfy the court. The three elements to make
it stick in court are TIME, INCLINATION, and
OPPORTUNITY. The TIME can be
relatively short, almost any amount of time will do if you have the other two elements. INCLINATION can be as simple as holding hands, a kiss or hug or any
form of affection that would be out of place. The third element is OPPORTUNITY. Opportunity is being alone with someone that you should not be alone
with in a place you should not be alone at. For example you can kiss a good
friend on the cheek and it wont get you in court, but if you kiss your friend on the cheek and
you follow that up with Time and Opportunity your in the wrong. If you are going to be alone
with someone, say at their house at night, then you should not be kissing them on the cheek,
or any where else for that matter, in public. If you are going to hug someone in public then
you should avoid giving the appearance of wrong doing by being alone with that person after
hours or in an inappropriate place. These are checks and balances set up by the court. You are
supposed to know your mate and if that mate is a jealous person than you need to avoid the
appearance of Adultery, according to most courts. On the other hand many cases are just for
Your Own Information and would not need Time, Opportunity and Inclination. In those cases
every effort is taken to get the best pictures, under the conditions. The courts have set up
the standard for Adultery so that pictures would not be necessary, and at the same time made
it illegal to take pictures that invade privacy. For example it is illegal to take pictures
through closed blinds even if there is a space and you can see through them. It is illegal to
go on someone's property for the purpose of taking pictures. But when your spouse says they
are going to work late and the Investigator gets a picture of your spouse with someone of the
opposite sex going into a restaurant or bar, or gets pictures of your spouse kissing someone
when they are supposed to be at the office, well you get the picture. An Adultery case for
court can always be done with pictures as a side. You're going to file for divorce but you
want to be sure your doing the right thing. Get TIME, INCLINATION, OPPORTUNITY and PICTURES.
